A Chapter 7 bankruptcy usually results in an automatic stay that pauses debt collection efforts by creditors after the debtor has filed the petition for bankruptcy. While many assets will be liquidated to discharge debts during this process, others will be protected from liquidation under exemptions. Chapter 7 bankruptcy is available only to debtors who meet the “means test,” which assesses an individual’s income relative to the median income in his or her state.

In the Chapter 13 process, by contrast, a debtor pursues a repayment plan over a period of three to five years. This may be useful not only for people who do not meet the means test but also for debtors who want to protect more of their assets from liquidation and prevent a lender from foreclosing on their home. In many situations, a couple will craft a pre-nuptial agreement that is designed to resolve these issues in advance, without relying on a judge’s order. These contracts generally are enforceable, but their validity may be challenged in some situations.

Fighting DUI Charges or Traffic Tickets

We can also help people who are facing a charge of DUI (driving under the influence) or who need help fighting a traffic ticket. DUI is a serious offense that can result in imprisonment of up to a year, a fine of up to $2,000, and a 90-day license suspension for a first offender. Each subsequent drunk driving conviction carries a stiffer penalty, including a possible felony conviction and 10 years in prison for a fourth offense. Under Alabama §32-5A-191, a person may be found guilty of this offense if he or she has a BAC (blood alcohol content) of 0.08% or more or is under the influence of a substance that impairs his or her faculties to a degree that renders him or her incapable of safe driving. However, there are many potential defenses to a DUI charge that a knowledgeable attorney can investigate, such as a lack of probable cause to stop your vehicle or problems with the manner in which a test was performed.
